Is it permissible to issue a fatwa that one pray Fajr at home before going to work if a bus delay would lead to missing the prayer or the congregational prayer, citing the hadith: "If one of you prays in his dwelling, then overtakes the Imam and has not prayed, he should pray with him, for it will be a supererogatory prayer for him"?

If a man misses the congregational prayer at the mosque, he prays at home. Then, if he reaches the mosque and wishes to repeat the prayer in congregation, there is no harm in that, even if it is the dawn prayer, according to some jurists. For an individual who prayed alone to repeat the prayer in congregation is legislated. Imam Al-Nawawi said: "If a person prays the obligatory prayer alone, then catches a congregation praying it within the time, it is recommended for him to repeat it with them." However, if he does not find a congregation in the mosque, he should not repeat it alone, due to the prohibition of repeating a prayer twice, and he must not let the prayer go beyond its prescribed time.
