Is it permissible for a woman to seek divorce or khul’ from her husband whom she cannot tolerate and with whom she does not fulfill her marital duties, despite her father’s refusal and anger if she divorces?

Divorce is disliked in Islamic law, and it is not permissible for a woman to seek divorce without a convincing reason, due to the saying of the Prophet (peace be upon him): "Any woman who asks her husband for divorce without any strong reason, the scent of Paradise will be forbidden to her."

So, if the sister is not harmed by remaining with her husband and is able to fulfill his rights, then she must obey her father and remain under her husband's marital bond. She should ignore feelings of hatred and aversion, as they might be from Satan.

However, if she hates her husband and is repulsed by him, and cannot fulfill his rights, then it is permissible for her to seek separation through khul' (divorce at the wife's instance, usually with compensation) or divorce. Ibn Qudamah said: "If a woman dislikes her husband due to his physical appearance, or his character, or his religiosity, or his age, or his weakness, or anything similar, and she fears that she will not be able to fulfill Allah's rights, then it is permissible for her to seek khul' from him in exchange for compensation..."

In this case, she is not obliged to obey her father in remaining with her husband, and she does not sin by disobeying him, because obedience to parents is not obligatory in matters that harm the child. She should explain to her father the reasons for her seeking separation and strive to convince him so that he may be content.
