How many effective divorces have occurred, and is the questioner still the man's wife?

A husband's frequent swearing by divorce is a mockery of God's verses and is characteristic of the oaths of the dissolute. The husband's statement: "You will be divorced by three if you go out" could imply a promise or a conditional divorce. If he intended the latter, the divorce would be thrice, according to the majority of scholars. Ibn Taymiyyah said: He must pay an expiation for an oath if he did not intend divorce, but if he did, then one divorce is binding. As for "You are divorced," it is an explicit divorce that does not require intention, but it does not take effect if preceded by three divorces. After three divorces, you become unlawful to him until you marry another husband. Reconciling ( رجعة ) is not valid after three divorces or the expiration of the waiting period (iddah (definition)), but it is valid if proven by witnesses or by the wife's confirmation. Reconciling is not valid by mere intention. His statement "She is forbidden to me, she will not return home" entails consequences according to his intention: divorce, dhihar (injurious assimilation), ila (oath of abstinence), or expiation for an oath. "I swear by divorce, if you add to what you've said, you will be traveling tomorrow" results in divorce if he breaks his oath and did not intend it as a mere promise. His statement "You are not divorced yet, I will ask a shaykh" does not result in divorce. We advise referring the matter to the Sharia (definition) court.
