The trustee is not liable for what is lost from the entrusted item without transgression or negligence on his part, according to the majority of scholars. For the entrusted item is a trust, and liability negates the concept of trust. Therefore, if the shepherd did not transgress or neglect what perished from the sheep, he is not liable, nor is he required to compensate their owners, even if he acquires sheep thereafter.
