Does a second husband inherit from his deceased wife if she has brothers and sisters, and if she has no children from him, and is he obliged to bear the costs of her wake and burial?

A husband must provide for his wife and children equitably. If the wife spends on herself, forfeits one of her rights, or performs some of his duties voluntarily, she will be rewarded for it. This does not nullify the husband's right to inheritance, as his share is half of his wife's estate if she leaves no children.

Scholars differ on whether the husband is obligated to provide the shroud for his wife. The Shafi'is and Abu Yusuf al-Hanafi affirmed this obligation, while the Malikis, Hanbalis, and Muhammad al-Hanafi denied it. The preponderant opinion is that the husband is obligated to prepare his wife for burial because he is responsible for her maintenance and clothing during her lifetime, so he must prepare her after her death. As for the expenses of funeral banquets (food served during mourning), they are an innovation and reprehensible.
