Is it permissible to accept a gift (a phone) that was obtained through bribery, and if not, is it permissible to donate its value and use it?

It is impermissible to accept the phone as a gift as long as it is known that it was obtained through bribery, because ownership of the bribe does not transfer to the briber. Sheikh al-Islam Ibn Taymiyyah stated that usurped money or money obtained through an unlawful contract is not permissible to take, whether through a gift, exchange, or otherwise. Al-Hafiz Ibn Hajar mentioned that a gift from someone whose wealth is known to be unlawful is forbidden. One should advise the relative and forbid him from taking bribes, due to the Prophet's saying, "May Allah curse the one who gives a bribe and the one who takes it."
