The questioner's return to her former husband and her request for it is not considered an injustice to his current wife, nor does it require her approval, as long as the husband is capable of being just and providing for both of them. The husband's emotional inclination is not held against him شرعًا (Islamically) as long as he is just in providing for them, spending nights with them, and fulfilling their rights, in accordance with the Almighty's saying: "But if you fear that you will not be just, then [marry only] one" and His saying: "So do not incline completely [toward one] and leave her [the other] in suspension." The man must be just in spending nights, providing sustenance, clothing, and housing. He is not permitted to incline his heart towards one over the other in a way that affects his treatment. The questioner is a stranger to her former husband until the marriage contract is concluded.
