What is the Shar'i ruling on dealing with a husband who imposes demands on his wife that are not forbidden but are beyond her capacity, while also abusing her with insults and beatings? And is the wife entitled to seek a divorce in this situation?

A husband does not have the right to insult his wife or beat her unless she is defiant (nashiz). Disobeying him in matters of common decency does not include compelling her to eat with her co-wife. A wife is not obliged to live with her co-wife and her children in the same place except with her consent, nor is she obliged to eat with her co-wife. Indeed, some scholars have explicitly stated that she is not obliged to eat with her husband. A wife is not obligated to accept humiliation and degradation, and it is not forbidden for her to seek divorce if there is a valid reason. The wife is advised to request regulation of her co-wife’s children entering her space and to request her food separately. If he complies and ceases his harm, it is better for her to remain with him. However, if he refuses and she believes that her remaining with him might expose her to what displeases Allah, then she may refer her case to the Sharia courts, and seeking divorce is the last resort.
