Is pressing the "agree" button to download a program, without regard for the written terms or the intention of swearing by divorce, covered by the fatwa "It is not permissible to swear by divorce to protect programs"?

It appears that merely pressing the agreement button for the oath within the program does not constitute a divorce, because he did not utter or write the divorce. Sheikh Muhammad ibn Ibrahim Al ash-Sheikh issued a fatwa stating that a man's signature on a divorce paper for his wife, without uttering or writing the divorce, does not effectuate it. This is because it does not fall under the pronouncements, allusions, or writings that constitute divorce.
