Is it permissible to remain in a land of disbelief (dar al-kufr) for the purpose of facilitating the performance of the Hajj pilgrimage, given the fulfillment of the conditions of capability (istita'ah), or is immediate migration (hijra) to a Muslim land obligatory?

We have previously clarified the conditions for residing in non-Muslim lands, and when emigration from them becomes obligatory and when it is recommended. If emigration is obligatory, you must leave those lands and return to Muslim lands. However, if it is recommended and your need has been met, then there is no sin upon you for remaining to secure an opportunity for Hajj. Nevertheless, it is preferable to hasten your return to your country, because warding off harm (the harms of residing in non-Muslim lands) takes precedence over gaining benefit (Hajj). Hajj is obligatory upon you if it becomes feasible from your home country; otherwise, there is no sin upon you.
