What are the conditions for the marriage of a divorced woman or a widow?

The conditions for marriage do not differ between a virgin woman and a non-virgin (previously married) woman in terms of the guardian, witnesses, the consent of both spouses, and the absence of legal impediments.

However, the difference between them lies in how consent to marriage is expressed. The previously married woman expresses herself explicitly through her words, while for a virgin, her silence when asked is sufficient for her permission, based on the Prophet's (peace be upon him) saying: "The previously married woman expresses herself, and the virgin's consent is her silence."
