It is not permissible to distribute the estate of a living person, even if the heirs agree and are in need; because the wealth remains the property of its owner and does not transfer to the heirs except upon his death. Guardianship (due to folly, minority, or insanity) does not mean the heirs' entitlement to inheritance, as the assets remain the property of their owner, and he should spend on them justly from his wealth if they are among those whose maintenance is obligatory upon him.
