Is a wife obligated to repay her father's debt from her own money, given that her husband, who borrowed the money, refuses to pay and has sworn by divorce that she should not do so?
If the husband is able to pay the debt, it is obligatory for him to pay it immediately, and it is not permissible for him to delay or deny it, for the delay of a rich person is an injustice. He must be advised and reminded of the seriousness of debt, for which he will be held accountable on the Day of Judgment, where it will be taken from his good deeds, if any, otherwise sins of those who have rights over him will be placed upon him, according to the Hadith of the Bankrupt.
One can seek the help of a person who has influence over the husband to advise him. The heirs have the right to take the matter to the Sharia court if they have proof of their right. However, if the husband is in straitened circumstances, the debt must be deferred until he is able to pay it, as Allah Almighty says: "And if there is one in [financial] difficulty, then [let there be] postponement until [a time of] ease." The wife is not obligated to volunteer to pay off her husband's debt, nor should she do so if it leads to divorce and family disintegration. The wife should show him this fatwa and strive to advise him and pray for him, and try to reconcile between him and her family.
