The question

What is the ruling concerning the wife's return with premeditated intent and its execution? What is the status of the husband and wife? Is the husband living in a permissible or unlawful state? And is the marriage valid given the prior agreement that another man would have intercourse with her before the marriage contract?

The answer

If the husband takes his wife back during her iddah (waiting period), or concludes a valid marriage contract with her after its expiry, then she returns to being his wife, and his ill intention is not taken into consideration. As for his act of bringing a man for his wife to have intercourse with, this is pimping (dayouthah) and a grave abomination, and Allah has forbidden Paradise to the pimp. The wife and the foreign man committed a great indecency and deserve stoning. All of them are partners in sin, and they must repent sincerely. If the conditions for a valid marriage are met, then it is valid. However, a separation must be made between the spouses if they colluded in sexual intercourse in a forbidden place or insisted on this abominable act.
