If I catch the Imam in the second Raka'ah and sit with him for the Tashahhud, do I recite the Tashahhud with him or not?

Yes, the latecomer (masbuq) should recite the with the Imam in his final sitting, even if that rak'ah is the first or third for the latecomer in a four-rak'ah prayer, in order to follow the Imam. This is based on the Prophet's (peace be upon him) saying: "When one of you comes and the Imam is in a certain state, let him do as the Imam does."
