If a person buys a house not for trade or to evade , then there is no zakat due on the seller of the house if he received the price before a full year passed while it was in his possession. As for the buyer, zakat becomes obligatory on him because he is still indebted for the price, and ownership is established for him, but debt may waive zakat in some cases. However, if the purpose of the purchase was trade or to evade zakat, the ruling differs. The separation that annuls the option in a sale is the separation from the sales مجلس (assembly).
