The woman's guardian (her brother) does not have the right to prevent her from marrying if a suitable suitor proposes to her, as the Prophet, peace and blessings be upon him, said: "If someone whose religiosity and character you approve comes to you, then marry him." If he prevents her, she has the right to go to the ruler or his deputy to marry her off, as the Prophet, peace and blessings be upon him, said: "If they dispute, then the ruler is the guardian of whoever has no guardian." She is also permitted to transfer to a more distant guardian. It is not permissible for a woman to marry herself without a guardian, as the Prophet, peace and blessings be upon him, said: "There is no marriage except with a guardian."
