Does the husband's statement, "I swear by divorce that if any of your sisters enters here (the marital home) or if you go to them (your family's home), you are divorced," constitute a third divorce? Does the ruling differ based on the husband's intention or the wife's statement? Does the oath include all apartments in the wife's family home except for her sick mother's apartment? What are the possible legitimate solutions if the oath is broken, considering the mother's illness and the husband's untruthfulness?

This is a conditional divorce, and according to the majority of scholars, it takes effect upon the fulfillment of the condition, unless the husband intended to specify a time or place. The wife becomes irrevocably divorced (baynunah kubra) if one of her brothers enters her apartment or she goes to her family's house. However, Sheikh al-Islam Ibn Taymiyyah is of the opinion that it does not take effect if the intention behind it was threat, prevention, or encouragement, and in such a case, an expiation for a broken oath (kaffarat yamin (definition)) becomes obligatory. What is considered in divorce is the husband's statement and his intention. The wife can maintain ties with her family via phone or in a nearby house to avoid the occurrence of divorce.
