Is it permissible for a wife to seek divorce from her husband who declared his conversion to Islam then apostatized from it, and rejected her advice, and does not work?
It is not permissible for a Muslim woman to remain married to a disbeliever. If the husband apostatizes from Islam, the marriage between them is Islamically nullified. If the husband insists on his apostasy, the wife no longer belongs to him, and she must strive to end this marriage through divorce, khula', or other means, and not let the children be an obstacle to that, for a disbeliever has no guardianship over believers. It is advisable to present the case to Islamic centers to seek assistance.
