Contemporary jurists have differed regarding the permissibility of selling bid documents in tenders. Some have permitted it, believing that the purpose of selling it at a relatively higher price than its book value is to prevent non-serious bidders from participating. Others, however, believe that the organizing entity of the tender should bear the cost of preparing the document, and thus it is not permissible to sell it. The preponderant opinion is the permissibility of selling the bid document for a price not exceeding its actual value, as stated in the resolution of the Islamic Fiqh Academy No. 77 / 4 / 85.
