Does a triple divorce under the influence of alcohol count? Is it considered one divorce or three? And is a return (reconciliation) valid by intention, or does it require cohabitation?
If a man divorces his wife with three pronouncements while he is intoxicated, the majority of jurists hold that the triple divorce takes effect, and she is not lawful for him until she marries another husband. However, Sheikh al-Islam Ibn Taymiyyah is of the opinion that the divorce of an intoxicated person does not take effect at all, and if he was not intoxicated, then the triple pronouncement is considered a single divorce. As for reconciliation (ruju'), it occurs by verbal declaration by consensus, and by sexual intercourse according to the preponderant view. However, intention alone does not achieve reconciliation. It is preferable to refer such cases to the Sharia court.
