What is the ruling on a wife who sold the marital home and traveled with the minor children to a foreign country without her husband's knowledge, and refuses to return, and has changed the children's affiliation from the father's side?
This issue is one of disputes that necessitate the request for evidence, and it is best handled by the courts. It is not permissible for a wife to travel without her husband's permission unless there is a necessity; otherwise, her maintenance allowance (nafaqa) is forfeited and he is permitted to discipline her. It is forbidden for her to travel with her children without their father's permission, even after divorce, if it is a journey of relocation. Inciting children against their father is one of the worst actions. She is permitted to dispose of her own property, but as for what belongs to her husband, she is not permitted to dispose of it without his permission.
