Is it permissible to receive a continuous salary from the Libyan university despite not working and the leave procedures being suspended, and if not, is it permissible to take it until circumstances ease and then donate it as charity?
If salaries are disbursed with the knowledge of the responsible authorities, there is no harm in benefiting from them, even if you are not currently working, as long as you have not refused to work and the responsible authorities are content with the continuation of the contract. Submitting a leave request does not entail anything unless it is approved.
However, when the university opens or the leave is approved, it is not permissible to take the salary except by returning to work. If the disbursement continues without returning, it is not lawful for you to take it except in a case of extreme necessity, where it is permissible to take only what is necessary, and you are not obligated to return what was taken or donate it; because fulfilling a necessity is a communal obligation (fard kifaya).
