What is the ruling of Islamic law concerning a man who has been sentenced by a Moroccan court to either marry a woman with whom he committed adultery or face five years in prison?

If the fornicator confesses or if four witnesses testify against him, he is to be given one hundred lashes if he is unmarried (a virgin), and stoned to death if he is married (muḥṣan), based on the Almighty’s saying: (The fornicating woman and the fornicating man, lash each one of them one hundred lashes) and due to the actions of the Prophet, peace be upon him.

Forcing the fornicator to marry the woman or imprisoning him is a ruling that contradicts Islamic law. However, if the two fornicators repent with sincere repentance, there is no objection to their marriage after the woman delivers her child if she is pregnant, or after she has completed her 'iddah (waiting period) with one menstrual cycle. It must be known that the child is not attributed to the fornicator, nor does he inherit from him, nor is he considered a maḥram to the man's daughters and paternal aunts.
