The basic ruling for commercial insurance is prohibition, but it is permissible to participate in it for public necessity or when legally mandated, especially for Muslims in Western countries where a -compliant alternative (Takaful insurance) is not available. Accordingly, the European Council for and Research has permitted commercial insurance in cases of legal compulsion or dire need to avert hardship and difficulty, such as insurance for Islamic institutions, cars, and homes against major risks, and health insurance to avoid exorbitant costs.
