Is the marriage formula that takes place in the mosque, with the Imam instructing the guardian of the husband and the guardian of the wife, sometimes in the absence of the husband, and the collective recitation of Al-Fatiha, valid and legitimate?
If the husband authorizes someone, such as his father or another, to accept the marriage on his behalf, the contract is valid, and the pillars of marriage, which we explained in Fatwa no. 111478, have been fulfilled. The Sunnah and the consensus of the Ummah have indicated the permissibility of agency in marriage, because there is a need for it. Reciting Al-Fatiha collectively or individually at the time of the marriage contract is not legislated.
