Is it permissible to give half the dates of a Waqf palm tree to someone in return for their care of it, and to give the other half in charity?

A waqf (endowment) must be maintained by spending from its proceeds. If there are no proceeds, then the beneficiaries should spend on it. If that is not possible, the waqf should be sold, and its price spent on a similar asset. The supervisor (nazir) may borrow money for its repair from its proceeds, or sell a part of it to repair the remainder if no other option is available. As for musaqat (sharecropping) on palm trees for half the fruit, this should only be resorted to in extreme necessity. The original principle is that its owners should manage it, or someone should be hired to manage it for a known wage, as long as the waqf is yielding benefit.
