Is a shoe considered ritually impure (najis) if it is splashed by a puddle of sewage water that a beer can was passing through? If a man dies and his wife is pregnant, she observes the waiting period until she gives birth, even if it is an hour after her husband's death. The waiting period is not waived due to her pregnancy. Allah Almighty says: {And for those who are pregnant, their term is that they deliver their burden} [At-Talaq (definition): 4]. This verse applies to a woman whose husband has died, as well as others. Imam Ibn Kathir said in his commentary: "As for the pregnant woman, her term is until she delivers her burden, and if she is not pregnant, her waiting period is four months and ten days." It is authentically narrated in Sahih (definition) Muslim from Subay'ah Al-Aslamiyyah that she gave birth a few nights after her husband's death. So she came to the Messenger of Allah (peace be upon him) and asked his permission to marry, and he gave her permission, so she got married. Al-Qurtubi said: "In this verse is proof that the waiting period for a pregnant woman is the delivery of her burden, whether she is divorced or her husband has died. This is the opinion of the majority of scholars." End quote. Therefore, if a man dies and his wife is pregnant, she observes the waiting period until she gives birth. When she gives birth, her waiting period has ended, even if it is an hour after her husband's death. And Allah knows best.
