Is it obligatory to renew the marriage contract for a woman with whom consummation has occurred while she is in her 'iddah period, and are the two divorces that occurred during this period counted after the contract is renewed?

If a woman married to a non-believer embraces Islam, she becomes separated from him, and her waiting period (iddah) begins from the moment of her conversion. If her iddah ends and he has not embraced Islam, she is permitted to marry someone else.

If you married this woman after the completion of her iddah, your marriage is valid. However, if you married her during her iddah, or during the iddah of her divorce from a Muslim man, then your marriage is void, and you are obliged to separate from her.

She must complete her first iddah (the duration of her stay with you is not counted), then observe another iddah (three menstrual cycles) from your intercourse with her.

Divorce in a void marriage is not recognized. If you wish to marry her after the completion of her first iddah, you may do so with a new contract, in the presence of her Muslim guardian and two witnesses, and the previous two pronouncements of divorce are not counted.

If she does not have a Muslim guardian, someone in a position of authority among Muslims, such as the Imam of the Islamic Center, may act as her guardian for the marriage.

Divorce does not occur in a marriage that is unanimously agreed upon as void, because it is a branch of it, just as if one were to marry his foster sister or marry a woman in her iddah.
