What is the ruling on divorcing a wife before consummating the marriage due to a lack of comfort with her and because she is not as religiously devout as desired, and does the Almighty’s saying, "There is no blame upon you if you divorce women whom you have not touched," apply to my situation?

The default ruling on divorce is prohibition unless there is a need for it. It is either haram (forbidden) or makruh (disliked). Scholars have differed regarding its ruling when there is no need. Some scholars view it as haram because it causes harm and destroys a benefit without need. Others view it as makruh because it removes the marriage, which encompasses many benefits. Scholars have also differed in interpreting the noble verse: "There is no blame upon you if you divorce women before consummating the marriage or specifying for them an obligation." (Quran 2:236). Some scholars believe it removes embarrassment from the divorcer before consummation absolutely, while others believe it applies specifically to those for whom no mahr (bridal-money) was specified, or that it removes embarrassment from divorcing them during menstruation. Regarding the wife's lack of activity in learning about religion and the issue of covering the face, these matters can be addressed. The fact that uncovering the face is a matter of scholarly disagreement does not detract from her religiosity. If she possesses good character and religious commitment, she should not be divorced for such reasons.
