If a husband falls short in his wife's rights, whether concerning maintenance or companionship, she is permitted to refrain from obeying him until he grants her due right. His right to her obedience is forfeited because he has not fulfilled her right. A wife may leave her husband's house without his permission if she fears for herself or her property, or if she needs to leave to seek her right from a judge, or for learning, or for a legal consultation (istiftaa').
