Is wearing the hijab considered an act of disobedience (maʿṣiyah) if it is done in obedience to a non-Muslim husband? And what should a Muslim wife do in this situation, especially since she is caring for him due to his health conditions and has no other provider?
If the wife embraces Islam while the husband remains in disbelief, it is not permissible for her to stay with him, as Allah the Almighty says: (Then if you ascertain that they are believers, send them not back to the disbelievers. They are not lawful for them, nor are they lawful for them). The woman is separated [from her husband] as soon as she embraces Islam. If her husband embraces Islam during her ' (waiting period), then they remain married. However, if he does not embrace Islam until her 'iddah expires, then she is irrevocably separated from him, and she may marry someone else, or she may wait for him to embrace Islam. A Muslim woman must separate from her disbelieving husband immediately. It is not permissible for her to serve or care for him. Poverty is not an excuse for remaining with a disbelieving husband, for Allah has guaranteed the provision of the pious. It is incumbent upon the son to treat his non-Muslim father with kindness, and upon the mother to invite him to Islam.
