Is the fiancé's discomfort with his fiancée after performing الاستخارة considered an injustice to her, and will he be punished for breaking off the engagement?
The problem is not clear as to whether the questioner has already contracted marriage with the girl or not. Therefore, she is advised as follows:
1. If the marriage contract has not been concluded (it is still an engagement): We advise her to leave the girl and look for another wife, because her discomfort with the girl will lead to injustice to herself and to the girl. For Allah commanded marriage to one whom a person desires and feels comfortable with, as He says: "Marry such women as seem good to you."
2. If the marriage contract has been concluded: We advise her to be patient and deliberate, for divorce is the most hated of permissible acts to Allah. She can postpone consummation and try to sit with her, reflect on her good qualities, and address the reasons for her aversion. For Allah Almighty says: "And live with them honorably. If you dislike them, it may be that you dislike a thing and Allah brings through it much good." And the Messenger of Allah, peace and blessings be upon him, said: "No believing man should hate a believing woman; if he dislikes one of her characteristics, he will be pleased with another." If these attempts do not work, then she may resort to divorce.
