If the offer (of marriage) is made in the form of a question, the marriage contract is not valid according to many scholars. Some scholars consider the context of the gathering, differentiating between a gathering for promising and one for contracting. However, if the offer is made in the form of a command, the marriage contract is valid. Regarding the girl being young, this does not affect the validity of the contract, but intercourse should not take place until she is able to tolerate it.
