Is it permissible for me to switch from smoking cigarettes to smoking shisha after having sworn by divorce to quit smoking, given that I am unable to quit it?

The fatwa, according to us, is that divorce takes effect when swearing by divorce, upon breaking the oath, whether the intention was divorce, threat, or anything else. This is the opinion of the majority of scholars. Accordingly, if you engage in smoking, your wife will be divorced. There is no difference between types of smoking unless you specified a particular type in your oath. We advise you to quit smoking because it is forbidden, and to avoid swearing by divorce in the future.
