Does a divorce take place if she smokes after her husband said: "If you smoke, you are unlawful to me, you are unlawful to me, you are unlawful to me"? And does the oath change by using another word instead of "dukhān" (smoke) such as "sajāyir" (cigarettes) or "sabāris" (cigarettes/cigars)?
Smoking is forbidden in all its forms, and one must stop it immediately, without gradualism, because of the Prophet, peace and blessings be upon him, who said: "If I forbid you from something, then abandon it." Thus, he commanded to abandon all prohibitions at once. As for the husband's conditioning the prohibition of his wife on smoking, it depends on the husband's intention: if he intended divorce, then it is a divorce; if he intended ẓihār, then it is ẓihār; and if he intended an oath, then it is an oath. It also depends on his intention to specify the type of smoke intended, and the repetition of the word also depends on his intention, whether it is for emphasis or for establishing a new ruling.
