Is it permissible for a woman to annul her marriage contract after three years of her husband's failure to provide for her or communicate with her, and his refusal to grant a divorce, due to the absence of an Islamic judge in Western countries?

If a husband neglects his duties towards his wife, such as providing maintenance, clothing, and other rights, she is entitled to refer her case to the Sharia judge or his representative to claim her rights or seek a divorce. If this is not available in her country, she may appoint someone to act on her behalf in another Muslim country, in application of the principle "harm shall be removed" and the Hadith "there shall be no harm or reciprocating harm."
