Is the young man obliged to pay the mahr if he divorces the girl in response to pressure from her family, and is the debt waived if the girl relinquishes it?
After the marriage contract (aqd al-nikah), the wife has an independent life with her husband, and he has more right over her than her family. Her husband has more authority over her than her parents, and obedience to him becomes more obligatory. Pressuring the husband to divorce his wife, and inciting the wife to seek divorce, is an act of incitement (takhbib), injustice, and sin, for "he is not of us who incites a woman against her husband." If the husband responds to the divorce, then if he had consummated the marriage with her or secluded himself with her, she is entitled to the full dowry. Otherwise, she is entitled to half of it. If the wife is mature and waives the dowry or a part of it after receiving it, then that is permissible and valid.
