Does a Christian wife, who is not a Muslim, deserve a deferred dowry (mu'akhkhar al-sadaq) after divorce from a legitimate Islamic marriage, bearing in mind that the civil marriage between them is in the process of divorce?
Marriage has conditions for its validity. If a condition is violated, the marriage becomes null and void. However, a void marriage entails consequences similar to a valid marriage, such as the entitlement to the dower (Mahr). Separation in such a marriage occurs through divorce (Talaq) or annulment (Faskh). The husband's verbal pronouncement of divorce is sufficient; the divorce decreed by secular courts is not sufficient on its own. There is no harm in documenting the divorce in courts after it has been pronounced.
