What is the criterion for applying the description of "fisq" (transgression/wickedness) according to scholars, and is it relative among people, or is it limited to issues of consensus? And does it include matters of dispute, such as praying behind someone who lets his garment drag (al-musbil) or shaves his beard?

The definition of a fasiq (transgressor/sinner) according to scholars is one who commits a major sin that necessitates a prescribed punishment (hadd) in this world or a threat of punishment in the Hereafter, or one who persistently commits minor sins. Disagreement may arise in classifying certain forbidden acts as major sins, which could lead to the descriptor of fasiq being applied to someone undeserving of it. Sheikh Abd al-Muhsin al-Abbad holds that the term fasiq is applied to clear, agreed-upon matters like drinking alcohol and adultery, and not to every sin.
