Is a girl's marriage to a non-Arab man without her guardian's knowledge, and her claim to have been married to him for six months, Islamically valid?

It is not permissible for the woman's guardian to reject a suitor who possesses good character and religious commitment, based on the Prophet's (peace be upon him) saying: "If there comes to you one whose character and religious commitment you are pleased with, then marry [your daughter] to him; otherwise, there will be tribulation on earth and widespread corruption." The woman has the right to choose her husband, and if he is suitable (kuf’) and she agrees to him, then the father is not permitted to refuse her marriage. Otherwise, he would be a 'āḍil (one who prevents marriage), and the guardianship would then transfer to the next closest guardian or to the ruler (sulṭān).

'Aḍl is the act of preventing a woman from marrying a suitable man. If she desires a specific suitable man and her guardian prevents her from marrying him, then he is a 'āḍil. However, if she requests to marry a man who is not suitable, then he has the right to prevent her.

The woman should be asked about the manner of her marriage. If she got married through a Sharia court or an Islamic center, then her marriage is valid. However, if she married herself and witnesses were present, her marriage is invalid according to the majority of scholars, due to the Prophet's (peace be upon him) saying: "Any woman who marries without the permission of her guardian, her marriage is invalid."
