Is the owner entitled to force the supplicant to take the house from him and give him another in the same street at market prices, and to demand from him the price difference for the increased area? And is the supplicant entitled to demand any amount he wishes for the apartment to compensate him for the suffering, given that he has been entitled to the house for seven years?
Muslims must fulfill their contracts and abide by the agreements and covenants they have made, even if they are not in writing, based on the words of the Almighty: "O you who have believed, fulfill [all] contracts" and "And fulfill [every] commitment. Indeed, the commitment is ever [that about which one will be] questioned." And for the : "Muslims are bound by their conditions."
Accordingly, the questioner has the right to demand the apartment he bought and for which he paid part of the price, and he should not be delayed. If he agrees to take another house at market price, there is no harm. However, he does not have the right to demand financial compensation for the suffering and delay. The questioner is advised to approach the court.
