Is a wife divorced if she swore an oath of triple divorce – intending to specify only the day of the oath – that she would close the phone while speaking to her husband, and then her phone closed without her intention? Is this considered an oath, do its repercussions extend to the future, and is expiation necessary?

Most scholars are of the opinion that swearing an oath by divorce and making it conditional upon an event results in divorce upon the fulfillment of the condition, and that pronouncing divorce three times results in three divorces.

However, Sheikh Al-Islam Ibn Taymiyyah holds that swearing an oath by divorce, when the intention is not divorce but rather a threat or an emphasis, is subject to the same ruling as swearing an oath by Allah. In such a case, if the condition is fulfilled, an expiation for an oath becomes incumbent, and no divorce occurs. But if the intention is divorce by uttering the word "three," then one divorce occurs.

In this specific case, as long as the wife did not intentionally hang up the phone, but rather it was disconnected against her will, she has not broken her oath, and thus no divorce occurs, nor is any expiation required.

Furthermore, as long as the oath was only for this specific day, there is no breach of the oath if she hangs up the phone on another day; because the intention of the one swearing the oath specifies the general and restricts the absolute.

The permissible oath is that sworn by Allah Almighty. As for swearing by divorce, it is among the oaths of the dissolute, and one should be wary of it.
