Who completes the Hajj-e-Badal if the hirer dies before completing the rituals?
If the substitute performing Hajj dies after entering into the state of , the ruling concerning his Hajj depends on two situations:
First situation: If he dies before performing the standing at Arafat, or the Al-Ifadah, or the Sa'y between Safa and Marwa. These are the pillars of Hajj, and the majority of scholars hold that deputizing someone to complete the Hajj in this situation is not valid, and this is the most preponderant opinion.
Second situation: If he dies after performing the standing at Arafat, his Tawaf Al-Ifadah, and his Sa'y between Safa and Marwa, he has thus performed the pillars of Hajj. Any remaining acts (such as stoning, staying overnight, and the farewell Tawaf) are obligations that can be compensated for with a sacrifice (Dam).
