If the debtor is in straitened circumstances, he must be given time until he can repay. It is not permissible to take the matter to court, as Allah Almighty says: (And if there is one in [financial] difficulty, then [give him] time until a time of ease). However, if he is able and procrastinating, then he bears all the expenses you incur to reclaim your right, such as lawyer's fees, because his procrastination is the cause of these expenses. Not burdening him with them encourages procrastination and harms rights, provided that these expenses are just and without exaggeration.
