What is the ruling on increasing the weight in a bag of sugar if the agreement was for a specific weight?
If a person buys a sack of sugar weighing 50 kg, there are two scenarios:
1. If both the seller and the buyer know the real weight (more or less than 50 kg) before completing the sale, then the sale is valid, and the increase goes to the buyer or the decrease is borne by him. Either of them may retract from the sale before parting ways if they are not satisfied with the weight.
2. If the real weight was not known beforehand:
If the weight exceeds 50 kg, the excess belongs to the seller.
If the weight is less than 50 kg, the shortage is borne by the seller.
A slight and customary difference in measurement or weight is excused, with the increase going to the buyer and the decrease being borne by him.
If the difference is significant, the buyer has the right to claim the shortfall or his share of the price, and the seller has the right to claim the excess or its price.
If the sacks are sold as is and the buyer trusts the seller, the sale is permissible, and the mentioned rulings apply if any discrepancy appears.
