Is the punishment for drinking alcohol Hadd or Ta'zir?
Ta'zir is a disciplinary punishment imposed by the ruler for a transgression for which there is no prescribed hadd (fixed punishment) in , or when the conditions for establishing a hadd against the perpetrator have not been met. An example is someone against whom there is testimony of drinking alcohol, but the required number of witnesses is not complete. In this case, the hadd is not imposed; rather, ta'zir is applied. However, if drinking alcohol is proven and the conditions for establishing the hadd are met, then the hadd is imposed. Thus, the punishment for drinking alcohol is a hadd when the conditions are met, and ta'zir when they are not.
