Is there any objection to a grandfather gifting a house to his grandson who suffers from epilepsy, is unmarried, and unemployed? And is the objection of the grandson's aunts considered unjust, given that they have an unmarried sister who also suffers from epilepsy and whom they wish to reside in the house after the grandfather's passing?

It is permissible for a grandfather to dispose of his wealth through a gift (hibah (definition)), and this is not an act of injustice, because equality in giving gifts is only obligatory among direct children, and does not include grandchildren or other relatives.

The basic principle is that a person is permitted to dispose of his wealth as he wishes. Equality was only made obligatory among children based on the Prophet's (peace and blessings be upon him) hadith (definition): "Would you like them to be equal in their devotion to you?" He said: Yes. He said: "Then be equal among them." This ruling does not apply to other relatives.

Ibn Hazm was of the opinion that equality is not obligatory among grandchildren, their mothers, their wives, their slaves, or anyone other than one's own children.
