What is the ruling of Islamic law regarding obligating a tenant to pay a full year's rent in advance, when the landlord knows that the tenant receives his salary monthly and cannot pay the full amount?
It is permissible for the lessor to stipulate that the lessee pay the full year's rent in advance upon contracting, because this is in accordance with the nature of the contract and serves a benefit for the lessor. The general rule for conditions is validity and bindingness. If the contract is concluded without specifying a payment date, there is a difference of opinion among jurists on this matter; some are of the view that the lessor owns the rent immediately upon the contract, while others believe that he only owns it after the benefits have been utilized. The contract is the law between the contracting parties, as long as it does not violate Islamic law.
