What we see and prefer regarding this story is that a major irrevocable divorce (baynunah kubra) has occurred. This is because a divorce pronounced during menstruation is effective, and this is the view of the majority of scholars, unless the anger that led to the divorce deprived the questioner of his reason, or he strongly believed that the woman would kill herself or destroy his property. In such a case, the divorce would not be irrevocable. If the questioner consulted scholars and was convinced by their ruling that no irrevocable divorce occurred, then there is no blame on him. However, if the person consulted was unqualified to issue a fatwa, or issued it based on his whims, then he must sever his relationship with this woman because she has become irrevocably divorced from him with a major irrevocable divorce.
